1. Agreement to Terms

By accessing or using the TrackRival mobile application (“App”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree with any part of these Terms, you may not use the App.

2. Description of Service

TrackRival is a mobile application that provides a gamified competition platform for high-performance driver education (HPDE) track day participants. The App allows users to log lap times, compete in car-class-specific leaderboards, build head-to-head rivalries, and engage with a community of track day enthusiasts.

3. User Accounts

To use certain features of the App, you must create an account. You may register using third-party authentication providers including Google, Facebook, and Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information as necessary. We reserve the right to suspend or terminate accounts that contain inaccurate or misleading information.

4. User Content & Conduct

You retain ownership of content you submit, including car profiles, lap times, and profile information. By submitting content, you grant TrackRival a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content within the App and for promotional purposes.

You agree not to:

• Submit fraudulent lap times or falsified vehicle specifications
• Harass, threaten, or abuse other users
• Attempt to manipulate leaderboards, rivalry records, or achievement systems
• Use the App for any unlawful purpose or in violation of any applicable laws
• Reverse-engineer, decompile, or disassemble any part of the App

5. Rivalry & Competition Features

The rivalry system is designed for friendly, respectful competition. Optional “stakes” within rivalries (e.g., coffee, car wash) are honor-based social commitments and are not enforceable by TrackRival. No real money wagering is permitted through the App.

TrackRival reserves the right to flag, review, or remove lap times deemed suspicious by our statistical anomaly detection systems or community reporting. Times marked “Under Review” may be excluded from official standings.

6. Data Import & Third-Party Services

The App may allow you to import data from third-party timing applications (e.g., RaceChrono, Harry's LapTimer, TrackAddict). TrackRival is not responsible for the accuracy of data imported from third-party services. Your use of third-party services is governed by their respective terms of service.

7. Subscriptions & Payments

TrackRival offers both free and paid subscription tiers. Paid subscriptions are billed through the Apple App Store or Google Play Store. Subscription terms, pricing, and renewal policies are governed by the respective app store's terms. You may cancel your subscription at any time through your app store account settings.

8. Intellectual Property

The TrackRival name, logo, and all related branding are the property of TrackRival. The App and its original content, features, and functionality are owned by TrackRival and are protected by international copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. TrackRival does not warrant that the App will be uninterrupted, error-free, or free of harmful components. Lap time accuracy depends on the input method and source data; TrackRival does not guarantee the precision of any recorded times.

10. Limitation of Liability

To the maximum extent permitted by law, TrackRival shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. TrackRival is not responsible for any incidents that occur at track day events, on or off the track.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.
